Requirements for filing trade mark applications in New Zealand and Australia
Filing requirements to obtain filing date:
- applicant's full name and address
- details of the trade mark
- list of classes of goods and/or services (we can assist with drafting class specifications if required)
- priority details if claiming convention priority (6 month deadline)
Patents
Requirements for filing patent applications (convention or non-convention) in New Zealand and Australia
Filing requirements to obtain filing date:
- applicant's full name, address and nationality
- full names, address and nationality of each inventor
- information on how applicant obtained rights from inventors
- copy of complete specification, claims and drawings (in English)
- priority application details if claiming convention priority
Designs
Requirements for filing design applications in New Zealand and Australia
Filing requirements to obtain filing date:
- applicant's full name and address
- full name of the designer
- representations of the design and article, showing all views
- details of the specific design to prepare the statement of monopoly or novelty rights
- priority application details if claiming convention priority (6 month deadline applies)
IP Searches
We can provide trade mark searches as pre-filing register availability checks upon request.
Searches are also useful for freedom to operate and trade mark clearance searches, and these are usually undertaken on a country by country basis, and a few regions also, such as the European Union.
